Does Johnson & Johnson baby powder really have asbestos in it?

Johnson & Johnson, manufacturer of various types of baby products, has come under scrutiny for producing products that could be dangerous to babies and users. Recently, the company initiated a massive recall of one of their most widely used products, baby powder. The company took this step after Food and Drug Administration testing revealed there were trace amounts of asbestos in a bottle.

The company pulled 33,000 bottles of baby powder off the shelves as a result of this finding. When a company produces something that could ultimately cause harm to consumers, it could be liable for the harm caused to users. As you may know, Johnson & Johnson has already faced extensive legal action for products that supposedly contribute to the development of cancer.

Should you be concerned?

After the FDA found trace amounts of asbestos in the powder, Johnson & Johnson initiated independent testing of the product. The company stated that it did not find any hint of asbestos, even after having two outside companies run tests. Despite these findings, the FDA says it is standing by the results of its own testing. As a concerned consumer, who can you trust? If you used baby powder made by this company or you used it for your children, are either of you in danger?

Talc powder comes from a material that can contain naturally occurring traces of asbestos. For approximately 40 years, the company has regularly tested its products to ensure that they are safe for regular consumer use. Johnson & Johnson says that it has run thousands of quality control tests, and none of them showed dangerous contaminants.

Ongoing legal trouble

Over the last few years, this company has faced ongoing litigation over claims that its baby powder products have led to the development of cancer, specifically mesothelioma and ovarian cancer. There have been several significant verdicts against the company since victims started coming forward. However, appeals have resulted in the reversal of many of these verdicts, and several more appeals are ongoing.

What about you?

If a consumer becomes ill as a result of a product he or she bought for personal use, it could be grounds for a civil claim. You have the right to pursue compensation from the liable parties, including recovery of your medical bills and damages for your emotional duress. Product liability claims can be complex, which is why consumers often find it helpful to first speak with a Louisiana attorney regarding their legal options.
